RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT
READ BEFORE SIGNING – UNDER 18 REQUIRES PARENTAL CONSENT
ACTIVITY: YAMPA RIVER FEST
Including Stand-up-paddleboard, Rafting, Kayaking, Tubing, Dog Fetching, Spectating, or Volunteer Work
THE UNDERSIGNED HEREBY AGREES NOT TO CONSUME ALCOHOL BEFORE PARTICIPATING IN ANY ACTIVITY
In consideration for being permitted to participate in the Activity, I, the undersigned, acknowledge and agree to the following:
1. Assumption of Risk. I fully understand that participating in the Activity may not only involve risk of serious injury, permanent disability, paralysis, or death, economic loss, property damage or loss that may result from my own actions, inactions or negligence, but also from the actions, inactions or negligence of others, including Friends of the Yampa, Inc., and/or natural conditions, and I voluntarily agree to assume this risk.
2. Covenant Not to Sue. I, my personal and legal representatives, heirs, successors and next of kin will not make any claim against Friends of the Yampa, Inc., or any of its present or former officials, employees, agents, attorneys, affiliates, insurers and representatives and their respective successors, heirs and assigns or any volunteer(s) (collectively “RELEASED PARTIES”), for injury, damage, death or any other loss arising from or related to participating in the Activity.
3. Release and Indemnification. I, my personal and legal representatives, heirs, successors and next of kin shall forever release, waive, discharge, relinquish and indemnify the RELEASED PARTIES from any and all actions, causes of action, claims, charges, demands, losses, damages, costs, attorney's fees, judgments, liens, indebtedness and liabilities of every kind and character, whether known or unknown, including foreseen or unforeseen bodily injury and personal injuries and property damage that may be sustained by me or any other person in any way connected to, related to, or arising out of my participation in the Activity, regardless of any negligence of the RELEASED PARTIES.
4. Good Health & Experience. I warrant that I am in good health and have no physical condition that would prevent me from participating in the Activity. I have had the opportunity to seek medical advice for any concerns I may have had regarding my health. I warrant that I have the necessary experience and capabilities to participate in the Activity.
I have carefully read this Release and Waiver of Liability and Assumption of Risk Agreement (the “Agreement”) and fully understand its contents. I am aware that I have given up substantial rights by signing the Agreement, and I am signing the Agreement voluntarily. I have no obligation to participate in the Activity or sign this Agreement, but I desire to do so.

PARENTAL OR LEGAL GUARDIAN AGREEMENT
IN CONSIDERATION of my minor child (“the Minor”) being permitted to participate in any way in the Activity, I agree:
1. I hereby certify that I am the adult parent or guardian of the minor child named below. I fully understand the nature of the Activity and the Minor’s experience and capabilities, and believe the Minor to be qualified to participate in the Activity. If the Minor will be bringing their own equipment, I have personally inspected that equipment. If I or the Minor believe anything is unsafe, I will instruct the minor to immediately refuse to participate further in the event(s).
2. I fully understand that the Minor’s participation in the Activity may not only involve risk of serious injury, permanent disability, paralysis, or death, economic loss, property damage or loss that may result from the Minor’s own actions, inactions or negligence, but also from the actions, inactions or negligence of others, including Friends of the Yampa, Inc., and/or natural conditions, that there may be other risks not known to me or that are not readily foreseeable at this time, and I voluntarily agree to assume those risks.
3. I consent to the Minor’s participation in the Activity and hereby accept and assume all such risks, known and unknown, and assume all responsibility for the losses, costs and/or damages following such injury, disability, paralysis or death, even if caused, in whole or in part, by the negligence of the RELEASED PARTIES named below.
4. I hereby release, discharge and covenant not to sue Friends of the Yampa, Inc., or any of its present or former officials, employees, agents, attorneys, affiliates, insurers and representatives and their respective successors, heirs and assigns or any volunteer(s) (collectively “RELEASED PARTIES”), from all liability to me, the Minor, my and the Minor’s personal representatives, heirs, and next of kin, for any and all claims, demands, losses, or damages on account of any injury to me or the Minor, including, but not limited to, death or damage to property, caused or alleged to be caused, in whole or in part, by the negligence of the RELEASED PARTIES or otherwise.
5. If, despite the release, I, the Minor, or anyone on the Minor’s behalf, makes a claim against any of the RELEASED PARTIES named above, I agree to defend, indemnify and save and hold harmless the RELEASED PARTIES and each of them from any litigation expenses, attorney fees, loss, liability, damage, or cost they may incur due to the claim made against any of the RELEASED PARTIES named above, whether the claim is based on the negligence of the RELEASED PARTIES or otherwise.
6. I sign this agreement on my own behalf and on behalf of the Minor. I HAVE READ THIS PARENTAL CONSENT, RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, UNDERSTAND THAT BY SIGNING IT I GIVE UP SUBSTANTIAL RIGHTS I AND/OR THE MINOR WOULD OTHERWISE HAVE TO RECOVER DAMAGES FOR LOSSES OCCASIONED BY THE RELEASED PARTIES FAULT, AND SIGN IT VOLUNTARILY AND WITHOUT INDUCEMENT.
